Wikipropedia — Terms & Conditions

PLEASE READ CAREFULLY

Wikipropedia provides AI-generated informational content about animal health. It is not veterinary care, it does not diagnose or treat your animal, and it is not a substitute for examination by a licensed veterinarian.

If your animal is experiencing an emergency, stop reading and contact a local emergency veterinary hospital immediately.

These Terms contain a binding arbitration provision and a class action waiver (Section 16) that affect your legal rights. They also limit our liability to you (Section 14).


1. Agreement to these Terms

These Terms & Conditions ("Terms") are a binding legal agreement between you ("you", "your", or "Member") and CRAB PULSAR LLC, a Delaware limited liability company ("Wikipropedia", "we", "us", or "our"), governing your access to and use of the website at wikipropedia.com, and all related content, features, and services (collectively, the "Service").

By accessing the Service, creating an account, submitting a message, purchasing a membership, or clicking a button indicating your acceptance, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You agree that your electronic acceptance constitutes your signature and manifests your assent to these Terms.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract. The Service is intended for users located in the United States. We make no representation that the Service is appropriate, lawful, or available in any other jurisdiction, and you access it from elsewhere at your own risk and are responsible for compliance with local law.

By using the Service you represent and warrant that you meet these requirements, and that you are the owner of, or are lawfully authorized to make care decisions for, any animal you discuss.

3. What the Service is

Wikipropedia is an informational and educational service. Through it you may:

  • exchange messages with Vicky, an AI assistant, about your animal;
  • exchange messages in the Care Room with AI-generated personas that present veterinary and allied-professional credentials and specialties;
  • request a Consensus Diagnosis report — an informational summary generated by multiple independent AI models;
  • maintain profiles and record-keeping for yourself and your animals, including care reminders and schedules;
  • in some cases, receive general information contributed or reviewed by a human veterinarian (see Section 4.3).

WIKIPROPEDIA IS AN INFORMATION SERVICE ONLY — A QUESTION-AND-ANSWER AND GENERAL-INFORMATION WEBSITE, AND NOTHING MORE.

Everything the Service provides is general, educational, informational content of the same character as an article, an encyclopedia entry, or a public question-and-answer forum. It is intended to help you become better informed and to have better conversations with your own veterinarian.

WE DO NOT PROVIDE, AND NOTHING IN THE SERVICE CONSTITUTES, ANY OF THE FOLLOWING:

  • veterinary advice, veterinary medicine, diagnosis, treatment, or prescribing;
  • medical or health advice of any kind, for any animal or any person;
  • legal advice;
  • financial, insurance, tax, or accounting advice;
  • professional advice or a professional opinion of any kind, in any field.

We are not a veterinary practice, a veterinary hospital, a clinic, a telemedicine provider, a pharmacy, a laboratory, a medical provider, or a law firm. We are not licensed as any of these in any jurisdiction, and we do not hold ourselves out as any of them.

No professional relationship of any kind — veterinary, medical, legal, or otherwise — is created between you and us, or between you and any persona, contributor, or person associated with the Service, by your use of it.

Any content that resembles advice — including anything phrased as a recommendation, an assessment, an urgency level, a differential, a "working diagnosis," a care plan, or a suggested dose — is general information presented for educational purposes only. Format is not professional judgment. The fact that information is specific, confident, individualized in tone, or presented by a persona bearing a credential does not make it advice, does not make it reliable, and does not make it something you may act on without your own veterinarian.

4. NOT VETERINARY CARE — THE MOST IMPORTANT SECTION OF THESE TERMS

4.1 No veterinarian-client-patient relationship

No veterinarian-client-patient relationship ("VCPR") is created by your use of the Service.

A VCPR — the legal and professional prerequisite for veterinary diagnosis, treatment, and prescribing — generally requires a licensed veterinarian to have physically examined your animal or to have made medically appropriate and timely visits to the premises where your animal is kept. That has not happened here and cannot happen through this Service.

Nothing in the Service constitutes:

  • the practice of veterinary medicine;
  • a diagnosis of any condition;
  • a treatment plan, prescription, or medical order;
  • a professional opinion upon which you may rely in place of your own veterinarian's judgment;
  • a substitute for physical examination, laboratory testing, or diagnostic imaging.
4.2 The AI personas are not veterinarians

The Service presents AI personas with names, avatars, credentials, and specialties — for example "Dr. Elena — Virtual DVM · Veterinary Cardiologist," "Nurse Tess — Virtual RVT," or similar.

These are AI-generated characters. They are not real people. They are not licensed veterinarians, technicians, pharmacists, nutritionists, or trainers. They hold no license, registration, or credential of any kind in any jurisdiction. They have not examined your animal and cannot.

The prefix "Virtual" in every credential line, and the persona presentation throughout, are intended to make this unmistakable. You acknowledge that you understand these are AI personas and that you will not treat their output as the opinion of a licensed professional.

Persona names, specialties, and communication styles are design choices intended to make information easier to understand and act on. They do not confer competence, authority, accountability, or professional standing, and they must not be relied upon as if they did.

4.3 Human veterinarian contributions

From time to time, information provided through the Service may be contributed to or reviewed by a person who is a licensed veterinarian, and such messages may be labeled to indicate this.

Even where a message is labeled as coming from or being verified by a human veterinarian:

  • it is general educational information only, and is not individualized veterinary medical advice, diagnosis, treatment, or a professional opinion regarding your specific animal;
  • no VCPR is created, because no physical examination of your animal has occurred;
  • no veterinarian-patient, professional, fiduciary, or treatment relationship of any kind is formed between you and any contributing veterinarian, or between you and us;
  • the contributing veterinarian is not acting as your veterinarian, is not assuming responsibility for your animal's care, and may not be licensed in your state;
  • the information remains subject to every disclaimer, limitation, and exclusion in these Terms — including Sections 13 and 14 — to the same extent as AI-generated content;
  • you must still consult your own veterinarian before acting on it.

A label such as "verified" indicates only that we believe the contributor holds a veterinary credential. It is not a warranty of accuracy, correctness, currency, or suitability for your animal, and it does not elevate general information into veterinary care.

4.4 AI output is frequently wrong

You acknowledge and specifically agree that you understand the following:

  • AI systems produce false information. They generate plausible, fluent, confident text that can be factually incorrect, internally inconsistent, or entirely fabricated — a failure mode commonly called "hallucination." Confidence in tone is not evidence of correctness.
  • Output may be incomplete, outdated, or inconsistent with current veterinary standards.
  • Output may misinterpret your description, your photographs, or your animal's history — including in ways neither you nor we detect.
  • Different AI models may disagree. Where the Service reports agreement between models, that is a measure of model agreement only, not a measure of truth. Multiple AI models can be confidently wrong in the same direction at the same time.
  • Automated safety features may fail. The Service includes screening intended to detect emergencies, toxic exposures, and other urgent situations. This screening is imperfect and will sometimes fail to detect a genuine emergency, or misjudge severity. It is a supplement to your own judgment — never a replacement for it, and never a reason to delay care.
  • The absence of an emergency warning does not mean your animal is not in an emergency.
4.5 You must consult a licensed veterinarian

Always seek the advice of a licensed veterinarian who has physically examined your animal regarding any question about your animal's health.

Never disregard professional veterinary advice, delay seeking it, or discontinue treatment because of anything you read, receive, or infer from the Service. If your veterinarian's advice conflicts with anything the Service says, follow your veterinarian.

5. EMERGENCIES — SEEK IN-PERSON CARE IMMEDIATELY

THE SERVICE IS NOT FOR EMERGENCIES AND MUST NEVER BE USED IN PLACE OF EMERGENCY CARE.

Wikipropedia is not monitored in real time, cannot summon help, cannot see your animal, and cannot intervene. Responses may be delayed by minutes or hours, or may not arrive at all. There is no guarantee that any message will be read or answered within any time frame.

If your animal shows any sign of a medical emergency — including difficulty breathing, collapse, seizure, unresponsiveness, severe bleeding, suspected bloat, inability to urinate, suspected poisoning or toxin ingestion, heatstroke, birthing difficulty, or major trauma — stop using the Service and go to an emergency veterinary hospital immediately.

(Consultation fees may apply. These services are operated by third parties. We do not control them, are not responsible for them, and do not warrant their advice.)

Do not wait for a response from the Service. Delay can be fatal.

6. Assumption of risk and your responsibility

You are solely and exclusively responsible for all decisions you make regarding your animal's health and care, and for all consequences of those decisions.

By using the Service you knowingly, voluntarily, and expressly:

  • assume all risk arising from your use of the Service and from any action you take or decline to take based on it — including risk of illness, injury, suffering, or death of your animal, and any resulting financial loss or emotional distress;
  • acknowledge that information provided may be wrong and that acting on it may cause or contribute to harm, including irreversible harm;
  • agree that you will independently verify any information with a licensed veterinarian before acting on it;
  • agree that you, not Wikipropedia, are the decision-maker;
  • acknowledge that any delay in seeking in-person care is your decision alone, and that we expressly instruct you not to delay.
6.1 You accept these Terms for everyone in your household

You represent that you are authorized to accept these Terms on behalf of yourself and every other person who uses your account, accesses the Service through you, relies on information you obtain from it, or co-owns or helps care for any animal you discuss — including members of your household and any co-owner.

You agree that all such persons are bound by these Terms, including Sections 13, 14, 15, and 16, and that you will inform them of this. You agree not to permit anyone to use your account who is unwilling to be bound.

6.2 Release

To the fullest extent permitted by law, you release and forever discharge CRAB PULSAR LLC and its officers, members, managers, employees, agents, contractors, contributors, licensors, and suppliers from any and all claims, demands, damages, and causes of action, known or unknown, arising out of or relating to your use of the Service or any information obtained through it — subject to the same exceptions as Section 14 (this release does not reach gross negligence, recklessness, willful misconduct, or fraud, or any liability that cannot lawfully be released).

If you are a California resident, you expressly waive California Civil Code § 1542, which reads: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar provision of any other jurisdiction.

6.3 Insurance and subrogation

If any loss relating to your use of the Service is covered by insurance — including pet insurance, homeowner's, renter's, or any other policy — you agree to look first to that insurance, and you waive, and agree to cause your insurer to waive, any right of subrogation against us. Your insurer may not bring a claim against us in your name or by assignment, and you agree not to assign any claim against us to any insurer or other third party.

7. No prescriptions; medication guidance

We do not prescribe, dispense, or provide prescription medications or controlled substances, and nothing in the Service is a prescription or a medical order.

Any mention of a medication — including over-the-counter products and any dose, dosage range, or administration guidance — is general information only and must be confirmed with your own veterinarian before you administer anything to your animal.

Medications safe for humans or for one species can be lethal to another. Dosing depends on species, breed, weight, age, organ function, concurrent medications, and conditions that we do not know and cannot assess. Never administer any substance to your animal based solely on the Service.

8. Third-party AI providers and services

Responses are generated using AI models operated by third parties, which currently include Anthropic, OpenAI, Google, and xAI, and may change at any time without notice.

We do not control these models. We do not author, review, verify, or approve each generated response before you see it. We make no representation or warranty regarding any third-party model's output, and we are not liable for it. Their content is provided to you subject to every disclaimer and limitation in these Terms.

The Service also relies on other third-party providers (including Stripe for payments and Microsoft Azure for hosting) and may link to third-party resources. We are not responsible for third-party services, content, or conduct. See our Privacy Policy for how your information is shared with these providers.

9. Your account

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us immediately at support@wikipropedia.com of any unauthorized use. Accounts are personal to you and may not be shared, transferred, or resold.

The quality of any information you receive depends entirely on the accuracy and completeness of what you tell us. We cannot see, examine, weigh, or test your animal. Incomplete or inaccurate information will produce incomplete or inaccurate output, and you accept responsibility for what you provide.

9.1 Text messages (SMS)

If you check the optional SMS box at sign-up (or later give us permission), you agree that we may send you transactional and account text messages at the mobile number you provide: care and reply updates, appointment and care reminders, billing and payment notices (including failed- payment notices), and sign-in links. Consent is not a condition of purchase or of using the Service. Message frequency varies; message and data rates may apply and are your responsibility. Reply STOP to any message to opt out (a final confirmation text may follow), or HELP for help; you can also email support@wikipropedia.com. Opting out of texts does not affect transactional emails required to operate your account. We do not send marketing text messages unless you separately and expressly opt in to them. Carriers are not liable for delayed or undelivered messages.

10. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or in violation of any veterinary practice act or other law;
  • represent the Service's output as veterinary advice, a diagnosis, or a professional opinion to any third party, or resell, redistribute, or commercialize it;
  • use the Service to make decisions about animals you do not own or are not authorized to make decisions for, or in any professional, clinical, research, breeding, agricultural, or commercial-livestock setting;
  • rely on the Service for any purpose where inaccurate output could cause injury or death, except as expressly contemplated (and disclaimed) by these Terms;
  • attempt to circumvent safety features, rate limits, paywalls, or access controls;
  • scrape, crawl, harvest, or use automated means to access the Service, or use it to train, fine- tune, evaluate, or develop any machine learning model;
  • reverse engineer the Service or attempt to extract prompts, personas, model configurations, or source code;
  • impersonate any person, including any veterinarian or Wikipropedia persona;
  • upload malicious code, or content that is unlawful, infringing, or that you lack the right to share;
  • interfere with, overload, or disrupt the Service or its infrastructure.

We may suspend or terminate access for any violation, at any time, without notice or refund.

11. Membership, billing, trial, auto-renewal, and refunds

11.1 Pricing and auto-renewal

Membership is offered as a 7-day trial for $1.00 (USD), which automatically converts to a recurring subscription of $35.00 (USD) per month unless you cancel before the trial ends.

YOUR SUBSCRIPTION AUTOMATICALLY RENEWS EACH MONTH AND YOUR PAYMENT METHOD WILL BE AUTOMATICALLY CHARGED $35.00 PER MONTH UNTIL YOU CANCEL. Renewal continues indefinitely at the then-current price until cancelled by you. Prices exclude applicable taxes, which may be added at checkout.

By purchasing, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel.

11.2 Cancellation

You may cancel at any time, during the trial or after, through your account settings or by emailing support@wikipropedia.com. Cancellation takes effect at the end of your current billing period. There are no cancellation fees. You retain access through the period you have paid for. Cancelling does not automatically delete your data — see the Privacy Policy.

11.3 Refunds — 7-day money-back guarantee

If you are not satisfied within the first 7 days of your membership, email support@wikipropedia.com and we will refund you in full. You do not need to give a reason.

We mean this and we will honor it as written. The following are the only conditions, and they exist to prevent abuse — not to create hoops:

  • Ask within the 7 days. The guarantee covers your first 7 days. Request it within that window, by email to support@wikipropedia.com from the address on your account.
  • One per person. The guarantee applies once per person and once per household — to your first membership only. It does not reset on a new account, a second account, a re-signup, or a returning membership.
  • Not available for fraud or abuse. We may decline where we reasonably determine the account was obtained fraudulently, the payment method was used without authorization, the Service was used in breach of Section 10, or the guarantee is being used repeatedly or in bad faith to obtain the Service without paying.
  • Refund of what you paid, to the original payment method. We refund the amount actually charged, to the method charged, normally within 5–10 business days once issued. We do not refund taxes or fees imposed by a third party where we cannot recover them.

After the first 7 days, payments are non-refundable, and we do not provide partial or prorated refunds for unused time in a billing period, except where required by law or granted at our sole discretion. Cancel any time (Section 11.2) — cancelling stops the next charge, and you keep access through the period you already paid for.

Nothing in this section limits any refund or cancellation right you have under applicable law that cannot be waived.

11.4 Payments

Payments are processed by Stripe, Inc. We do not receive or store your full payment card number. Your use of payment features is also subject to Stripe's terms. You are responsible for keeping your payment method current; failed payments may result in suspension. We may change pricing on at least 30 days' notice, effective at your next renewal; continued use after the effective date constitutes acceptance.

11.5 Chargebacks

If you initiate a chargeback rather than requesting a refund through us, we may suspend or terminate your account. Please contact us first — our refund policy is generous and we would rather resolve it directly.

12. Intellectual property

12.1 Ours

The Service — including software, text, personas, avatars, prompts, designs, trademarks, and the Wikipropedia name and logo — is owned by CRAB PULSAR LLC and protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable, personal license to use the Service for your own non-commercial animal care. All rights not expressly granted are reserved.

12.2 Yours

You retain ownership of the content you submit (messages, photos, documents, records).

You grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid license to host, store, reproduce, modify, adapt, translate, create derivative works from, process, analyze, transmit, and display your content, for the purposes described in our Privacy Policy — including:

  • operating, securing, and improving the Service;
  • transmitting it to the third-party AI providers in Section 8, and to our other service providers, which are contractually restricted to processing it on our behalf;
  • training, fine-tuning, evaluating, and developing artificial intelligence and machine learning models that we own or operate;
  • research, analytics, and product development, including creating de-identified or aggregated datasets;
  • marketing and promoting our own Service to you, subject to your opt-out rights.

This license is for our own use of your content. We do not sell your content or your personal information, and we do not license or sublicense it to partners or other organizations for their own purposes — see Privacy Policy Section 5.7.

Deleting your content or your account ends this license going forward, except for backups retained on our ordinary schedule, de-identified or aggregated data, content already incorporated into a trained model or a derivative work (which cannot practicably be extracted), and retention required by law.

You represent that you have the right to submit your content and to grant this license, and that your content does not infringe any third-party right.

12.3 Feedback

Any feedback or suggestions you provide may be used by us without restriction, compensation, or attribution.

12.4 Interactive computer service; user-supplied content (47 U.S.C. § 230)

Wikipropedia operates an interactive computer service as that term is defined in Section 230 of the Communications Decency Act, 47 U.S.C. § 230.

To the extent any content on or through the Service is provided by another information content provider — including content you or any other user submits, posts, uploads, or transmits, and content originating from a third party — we are not the publisher or speaker of that content under 47 U.S.C. § 230(c)(1), and we do not adopt, endorse, verify, or assume responsibility for it. We further claim the protection of 47 U.S.C. § 230(c)(2) for any good-faith action to restrict access to or remove material we consider objectionable, and for enabling others to do so.

We reserve all rights, immunities, and defenses available to us under Section 230 and any other applicable federal or state law.

We want to be straightforward with you about the limits of the paragraphs above, because you should not rely on a protection that may not exist. Section 230 shields a service from liability for information provided by another information content provider. Content that our own systems generate is not provided by another — it is ours. We therefore do not represent, and you should not assume, that Section 230 shields us from liability for AI-generated output, and a court may well hold that it does not. The provisions you and we are actually relying on for AI-generated content are Sections 4, 5, 6, 13, 14, 15, and 16 — the disclaimers, your assumption of risk, the limitation of liability, and the agreement to arbitrate. This section adds to those protections; it does not replace them, and nothing in it narrows them.

13. DISCLAIMER OF WARRANTIES

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY LAW, CRAB PULSAR LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY AND NO REPRESENTATION THAT:

  • ANY INFORMATION PROVIDED IS ACCURATE, TRUE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE;
  • ANY INFORMATION IS APPROPRIATE, SAFE, OR SUITABLE FOR YOUR ANIMAL OR YOUR SITUATION;
  • ANY ASSESSMENT, URGENCY LEVEL, DISPOSITION, DIFFERENTIAL, OR RECOMMENDATION IS CORRECT;
  • ANY EMERGENCY, TOXIN, RED FLAG, OR URGENT CONDITION WILL BE DETECTED, FLAGGED, OR CORRECTLY GRADED;
  • ANY MESSAGE WILL BE ANSWERED, OR ANSWERED WITHIN ANY PARTICULAR TIME;
  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR AVAILABLE;
  • ANY DEFECT WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF HARMFUL COMPONENTS;
  • ANY OUTCOME — INCLUDING ANY HEALTH OUTCOME FOR YOUR ANIMAL — WILL BE ACHIEVED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that event such warranties are limited to the minimum scope and shortest duration permitted by law.

14. LIMITATION OF LIABILITY

READ THIS SECTION CAREFULLY — IT LIMITS OUR LIABILITY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRAB PULSAR LLC OR ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, CONTRIBUTORS (INCLUDING ANY CONTRIBUTING VETERINARIAN), LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, UNDER ANY THEORY OF LIABILITY — INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, MISREPRESENTATION, OR STATUTE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY OF THE FOLLOWING, HOWEVER CAUSED:

  • ANY ILLNESS, INJURY, DETERIORATION, SUFFERING, DISABILITY, OR DEATH OF ANY ANIMAL;
  • ANY VETERINARY, EMERGENCY, SURGICAL, DIAGNOSTIC, MEDICATION, OR END-OF-LIFE EXPENSE;
  • ANY DELAY IN OBTAINING VETERINARY CARE, OR ANY DECISION TO SEEK OR NOT SEEK CARE;
  • ANY RELIANCE ON, ACTION TAKEN ON, OR FORBEARANCE BASED ON ANY INFORMATION FROM THE SERVICE, INCLUDING AI-GENERATED CONTENT AND HUMAN-VETERINARIAN-CONTRIBUTED CONTENT;
  • ANY FAILURE TO DETECT, FLAG, OR CORRECTLY GRADE AN EMERGENCY, TOXIN EXPOSURE, OR URGENT CONDITION;
  • ANY INACCURATE, INCOMPLETE, FABRICATED, OR HALLUCINATED OUTPUT;
  • ANY EMOTIONAL DISTRESS, GRIEF, MENTAL ANGUISH, OR LOSS OF COMPANIONSHIP;
  • ANY UNAUTHORIZED ACCESS TO YOUR DATA, OR ANY ACT OR OMISSION OF A THIRD-PARTY PROVIDER.

AGGREGATE CAP. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

THIS CAP APPLIES IN THE AGGREGATE ACROSS ALL CLAIMS AND ALL THEORIES AND IS NOT PER-INCIDENT.

EXPRESS NEGLIGENCE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS IN SECTIONS 13 AND 14 APPLY TO CLAIMS ARISING FROM OR RELATING TO OUR OWN NEGLIGENCE, INCLUDING ANY NEGLIGENT ACT OR OMISSION IN DESIGNING, BUILDING, TRAINING, TESTING, OPERATING, MONITORING, OR MAINTAINING THE SERVICE, ITS AI MODELS, OR ITS SAFETY FEATURES. YOU AND WE SPECIFICALLY INTEND AND AGREE THAT THESE PROVISIONS COVER OUR ORDINARY NEGLIGENCE, AND YOU KNOWINGLY ACCEPT THAT ALLOCATION OF RISK.

This section does NOT apply to, and we do not attempt to limit, our liability for gross negligence, recklessness, willful misconduct, or fraud.

SOLE AND EXCLUSIVE REMEDY. IF YOU ARE DISSATISFIED WITH THE SERVICE OR WITH ANY INFORMATION OBTAINED THROUGH IT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING IT AND TO CANCEL YOUR MEMBERSHIP, subject only to the refund rights in Section 11.3 and any remedy that cannot lawfully be excluded.

BASIS OF THE BARGAIN. You acknowledge that these limitations are an essential and fundamental basis of the bargain between you and us, that we have set our pricing in reliance on them, and that we would not provide the Service at this price, or at all, without them. You acknowledge that the fees you pay reflect this allocation of risk, and that the Service would have to be priced very differently if we bore the risk of outcomes for your animal.

TIME LIMIT. Any claim must be brought within ONE (1) YEAR after it arises, or it is permanently barred, to the extent permitted by law.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded — including, where applicable, liability for fraud, or for death or personal injury caused by our negligence. In such cases our liability is limited to the minimum permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless CRAB PULSAR LLC and its officers, members, managers, employees, agents, contractors, contributors, licensors, and suppliers from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your use of, or reliance on, the Service or any information obtained through it;
  • any decision, act, or omission by you concerning any animal;
  • any harm to any animal, person, or property connected to your use of the Service;
  • your breach of these Terms or violation of any law or third-party right;
  • content you submit;
  • any claim by a third party (including a co-owner, family member, veterinarian, insurer, or purchaser of an animal) arising from your use of the Service or your communication of its output to them.

We reserve the right, at our own expense, to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate. This section survives termination.

16. DISPUTE RESOLUTION — BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ CAREFULLY. THIS SECTION REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

16.1 Informal resolution first

Before filing anything, you agree to contact us at support@wikipropedia.com with a written description of the dispute and the relief sought, and to attempt in good faith to resolve it for 60 days. This is a condition precedent to arbitration. Both parties agree the limitations period is tolled during this period.

16.2 Agreement to arbitrate

If not resolved within 60 days, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including its formation, interpretation, breach, termination, validity, or enforceability, and including claims that arose before you accepted these Terms — shall be resolved exclusively by FINAL AND BINDING INDIVIDUAL ARBITRATION, and not in court, except as provided in Section 16.5.

Arbitration is administered by the American Arbitration Association (AAA) under its consumer arbitration rules in effect at filing. The Federal Arbitration Act governs this section, including its enforcement and interpretation.

  • Single neutral arbitrator.
  • Venue: the county where you reside, or another mutually agreed location. Telephonic or video hearings are available at your election, and claims of $25,000 or less may be resolved on documents alone at your election.
  • The arbitrator decides all issues, except that a court shall decide the enforceability of Section 16.4 (Class Action Waiver).
  • The arbitrator may award the same individual relief a court could, and no more. Any award of public injunctive relief, to the extent required by law, is severed to court under Section 16.6.
  • The award is final and binding and may be entered in any court of competent jurisdiction.
16.3 Arbitration costs

We will pay all filing, administration, and arbitrator fees for any claim of $10,000 or less, unless the arbitrator finds your claim frivolous or brought for an improper purpose. Above that, fees are allocated under the forum's rules. Each party bears its own attorneys' fees unless a statute or the award provides otherwise. If the forum's fees would prevent you from bringing a claim, we will pay them upon your written request.

16.4 CLASS ACTION WAIVER

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. You waive any right to a class action, and to serve as a class representative or class member.

IF THIS SECTION 16.4 IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THAT CLAIM — AND ONLY THAT CLAIM — IS SEVERED FROM ARBITRATION AND PROCEEDS IN COURT UNDER SECTION 17. ALL OTHER CLAIMS REMAIN IN ARBITRATION.

16.5 Exceptions

Either party may: (a) bring an individual claim in small claims court if it qualifies and remains individual; and (b) seek injunctive or equitable relief in court to protect intellectual property rights or address unauthorized access.

16.6 JURY TRIAL WAIVER

TO THE EXTENT ANY CLAIM PROCEEDS IN COURT, YOU AND WE EACH KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO TRIAL BY JURY.

16.7 YOUR RIGHT TO OPT OUT — 30 DAYS

You may opt out of this Section 16 by emailing opt-out@wikipropedia.com (or support@wikipropedia.com) within THIRTY (30) DAYS of first accepting these Terms, stating your name, the email on your account, and an unambiguous statement that you wish to opt out of arbitration.

Opting out affects nothing else — the rest of these Terms, including Sections 13, 14, and 15, continues to apply in full, and opting out will not affect your account, pricing, or service in any way. If you opt out, disputes proceed under Section 17.

16.8 Survival

This Section 16 survives termination of these Terms and of your account.

17. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, and by the Federal Arbitration Act as to Section 16.

For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, and waive any objection to venue or forum non conveniens.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. General

Changes. We may modify these Terms at any time. We will update the "Last updated" date and, for material changes, provide reasonable notice (such as by email or in-product notice) at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and cancel. Changes do not apply retroactively to disputes already arisen.

Termination. We may suspend or terminate your access at any time, with or without cause or notice. You may terminate by cancelling and discontinuing use. Sections 4, 5, 6, 8, 12, 13, 14, 15, 16, 17, and 18 survive termination.

Modification of the Service. We may change, suspend, or discontinue any part of the Service — including any persona, feature, or model — at any time without notice or liability. Personas are fictional and may be added, altered, or retired at will.

Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remainder stays in full force — subject to the specific rule in Section 16.4.

No waiver. No failure or delay in enforcing any right waives it. A waiver is effective only in writing.

Assignment. You may not assign these Terms without our written consent. We may assign them freely, including in a merger, acquisition, or sale of assets.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control — including model-provider outages, network or hosting failures, acts of God, or governmental action.

Entire agreement; non-reliance. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings, including any marketing statement or representation not contained here.

You acknowledge that in deciding to use or purchase the Service you are NOT relying on any statement, representation, promise, assurance, or warranty that is not expressly set out in these Terms — including anything on our website, in advertising, in email, in a persona's message, or said by any person. You agree that you have had the opportunity to read these Terms, that you have relied on your own judgment, and that any claim based on a representation outside these Terms is waived, except that nothing in this paragraph excludes liability for fraud or fraudulent misrepresentation, or limits any right under consumer-protection law that cannot be waived.

No third-party beneficiaries, except that the parties released and indemnified in Sections 14 and 15 may enforce those sections.

Relationship. No partnership, joint venture, employment, agency, or fiduciary relationship is created.

Headings and summaries are for convenience only and do not affect interpretation. These Terms shall not be construed against the drafter.

  2. The personas are AI, not licensed veterinarians, even where credentials are displayed.
  3. Human-veterinarian contributions are general information only and create no professional relationship.
  4. AI output can be confidently, seriously wrong, and safety screening can fail.
  5. You will consult a licensed veterinarian and will not delay care because of this Service.
  6. You assume all risk and are solely responsible for decisions about your animal.
  7. Our liability is limited (Section 14) — including for our own negligence — and disputes are individually arbitrated (Section 16).
  8. You accept these Terms for everyone in your household who uses the Service or relies on it (Section 6.1), and you release us from claims arising out of your use (Section 6.2).
  9. You are not relying on anything outside these Terms (Section 18).
